Terms of Service
Terms of use for ToyGate, AI-credit purchases, refunds, and limitation of liability.
Effective date: 19 August 2026
1. General provisions
1.1. These Terms of Service (the “Agreement”) govern use of the online service ToyGate (toygate.store) (the “Service”) provided by the Administration.
1.2. By using the Service — including registration, payment, or access to the API and materials — the User confirms that they have read and fully accept this Agreement.
1.3. If the User does not agree with the Agreement, the User must stop using the Service.
2. Nature of services and digital goods
2.1. The Service provides intangible digital goods and services. The primary digital good is AI credits: prepaid accounting units deducted when using the gateway API and related features.
2.2. Materials and capabilities available through the Service may include:
- access to the API gateway and model catalog;
- informational and reference materials;
- account, billing, and support features.
2.3. The User understands and agrees that the value of the Service’s digital goods and services lies in access, support, infrastructure, and updates, not in exclusivity of individual pieces of information or model outputs.
2.4. The Service does not warrant uniqueness, exclusivity, or continuous availability of particular models, upstream providers, or materials outside the Service.
3. Disclaimer of warranties and limitation of liability
3.1. The Service is provided “AS IS”.
3.2. The Administration does not warrant:
- that the Service will meet the User’s expectations;
- any financial, commercial, professional, or other results;
- uninterrupted or error-free operation;
- a fixed set of models or upstream provider terms.
3.3. The Administration is not liable for:
- any direct or indirect damages, including lost profits;
- consequences of the User’s use of materials or model outputs;
- acts or omissions of third parties (including payment and model providers);
- temporary outages or access restrictions.
3.4. All decisions about applying materials, recommendations, model outputs, and services are made by the User independently and at the User’s own risk.
4. Lawful use
4.1. The Service is not intended to encourage, organize, or facilitate unlawful activity.
4.2. The User must use the Service only in compliance with applicable law and third-party rules.
4.3. Responsibility for the lawfulness of using Service materials, APIs, and services rests entirely with the User.
5. Intellectual property
5.1. Materials published in the Service are protected by intellectual-property law.
5.2. The User may not copy, distribute, resell, transfer to third parties, or otherwise use Service materials without the rightsholder’s permission, except as expressly allowed by Service functionality.
5.3. Intellectual-property violations may result in restricted access without compensation.
6. Access restrictions
6.1. The Administration may suspend or restrict the User’s access if:
- this Agreement is breached;
- abuse is detected;
- law or payment providers so require.
6.2. Access restrictions do not release the User from earlier obligations.
6.3. The Administration may refuse service to Users whose actions create elevated risk for the Service, payment providers, or third parties.
7. Payments and refunds
7.1. Payment for AI-credit packages and other digital goods is made on the terms shown in the Service before checkout. AI credits are prepaid.
7.2. Because digital goods and services are intangible, no refund is available after AI credits have been granted to the account, except as stated below.
7.3. A refund may be considered only if:
- the service was not delivered due to a technical fault of the Service; or
- AI credits were not actually granted (payment unprocessed / order not successfully completed).
7.4. To request a refund for an unprocessed payment, the User must contact support within 24 hours of payment.
7.5. Refund decisions are made by the Administration on a case-by-case basis.
7.6. The User agrees not to initiate a chargeback through payment systems without first contacting Service support. Unjustified chargebacks may result in restricted access.
8. Privacy
8.1. Data processing is governed by the Privacy Policy.
8.2. Prompt and response bodies written to the internal prompt_logs table are retained for 7 days, as described in Prompt logging & retention.
8.3. An authenticated User may request erasure of their account data from the dashboard, as further described in the Privacy Policy.
8.4. The Administration takes reasonable measures to protect data but does not guarantee absolute security of transmitted information.
9. Changes
9.1. The Administration may amend this Agreement.
9.2. The current version is published in the Service.
9.3. Continued use of the Service constitutes acceptance of the updated terms.
